Complaints

Complaints follow a specific process required under IDEA. A complaint alleges (claims) that the school division has violated one or more provisions of IDEA or federal or state special education regulations. If the situation is complicated, it can be a good idea to talk with a lawyer before filing a complaint. When a properly submitted complaint is received, Virginia Department of Education (VDOE) compliance staff will investigate the complaint and issue findings. If VDOE finds that the school division is at fault on one or more issues, they may require a corrective action plan to fix the problem. A complaint must be filed within one calendar year from the original event. A complaint decision can be appealed by the parent or the school division.
